Overview

This Site provides access to the Maqetta Visual Design Tool that is hosted and maintained by the Dojo Foundation. The following Terms of Use apply to the use of http://maqetta.org (alternately referred to as the “Site” herein). These Terms of Use represent a binding legal agreement (the “Agreement”) between you and the Dojo Foundation as follows: by accessing, browsing, or using this Site, you acknowledge that you have read, understood, and agree to be bound by this Agreement and to comply with all applicable laws and regulations, including export and re-export control laws and regulations. If you do not agree to these terms, you may not use this Site.

The Dojo Foundation may, without notice to you, at any time revise these Terms of Use and any other information contained in this Site by updating this posting. The Dojo Foundation may also make improvements or changes in, or may discontinue, the products, services, or programs described in this site at any time without notice.

The Dojo Foundation hereby authorizes you to access and use this Site for development purposes under the license grant set forth below. Use of this Site by you (and any third party acting on your behalf) is solely at your own risk.

The Dojo Foundation grants to you a license to copy, reproduce, publish, upload, post, transmit, distribute, publicly display, perform, modify, create derivative works from, and otherwise freely use, the materials or information made available to users of the Site by the Dojo Foundation or its licensors on the Site, provided, however, that you will abide by all license terms, conditions, and notices accompanying such materials and information. You may upload information at your own risk: any information you store on the Site may be deleted or become otherwise inaccessible at any time and it is your responsibility to backup your data.

The Site contains proprietary notices and copyright information, the terms of which must be observed and followed. For example, you must include the following in any notices accompanying derivative works created by you that are based on materials accessed and used on the Site:

You may upload data and code onto the Site for the purpose of executing the code with the data on the Site. You must ensure that any data and code that you upload to the Site is your creation, in the public domain or that you obtain the requisite third party licenses for use of the data and code by you or others while on the Site.

“Harmful Code” means any computer programming code constructed with the intent or likelihood of damage to or interference with other computer programs, data files or hardware, without the knowledge or consent of the computer user. “Harmful Code” includes self-replicating and self-propagating program instructions such as viruses, worms, or the like. You will not, nor will you allow, authorize or direct others to (i) enter any viruses or Harmful Code to http://maqetta.org; (ii) effect any unlawful or improper activity or use of the Site; or (iii) post, transmit, or upload human test subject data or any information that can potentially be used to uniquely identify a person (“Personal Information”) to http://maqetta.org for which you have not received the written consent of the Personal Information’s owner to do so. Further, you will not, nor allow, authorize or direct others to, upload any data to the Site that would infringe any copyright, be subject to any prior agreements that would limit the scope of this Agreement, contain any defamatory or libelous subject matter, make any invasion of the right of privacy or publicity, and/or misappropriate any information of any third party (“Proprietary Information”), for which you have not received the prior express written consent of the Personal Information’s owner or Proprietary Information’s Owner to do so.

The Dojo Foundation does not want to receive confidential or proprietary information from you through our Site. You agree that all information or material sent, transmitted or otherwise provided to the Dojo Foundation will be deemed NOT to be confidential.

You agree that by sending, transmitting or otherwise providing to the Dojo Foundation any information or material, you grant the Dojo Foundation an unrestricted, irrevocable license to copy, reproduce, publish, upload, post, transmit, distribute, publicly display, perform, modify, create derivative works from, and otherwise freely use, those materials or information. You also agree that the Dojo Foundation is free to use any ideas, concepts, know-how, or techniques that you send us for any purpose. However, we will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless: (a) we obtain your permission to use your name; or (b) we first notify you that the materials or other information you submit to a particular part of this site will be published or otherwise used with your name on it; or (c) we are required to do so by law.

You will use reasonable care to fulfill your obligations under this Agreement and you agree to cease your own access and use (or withdraw authorization to others to do so on your behalf) if you or any third party authorized by you to act on your behalf violates the terms of this Agreement. If the Dojo Foundation determines, in its sole discretion, that there is a pattern of violation or abuse of the terms and conditions of this Agreement by you or third parties acting on your behalf in connection with use of http://maqetta.org, the Dojo Foundation may terminate this Agreement upon written notice. The Dojo Foundation may take any steps to protect the Site without notice to you.

You agree that any laptop, computer system or other owned equipment owned by you which has an active connection to http://maqetta.org shall not be configured with the intent to hide its identity by masking its IP address.

You will not, in connection with your use of http://maqetta.org:

  • Generate or promote any harmful, threatening, abusive, harassing, defamatory, hateful, obscene, or otherwise unlawful content;
  • Use http://maqetta.org to conduct or support any unlawful or improper activity;
  • Make any attempt to circumvent any technical restrictions (e.g., breaching firewalls or creating connections to unauthorized computing systems or networks, including the internet) or security protections in place for http://maqetta.org;
  • Impersonate any person or entity, or communicate under a false name or a name you are not entitled or authorized to use;
  • Post or transmit any communications or solicitation designed or intended to obtain password, account or private financial information from any other person;
  • Use your access and usage rights to the Site or the results from that use to promote or accomplish any hazardous activity;
  • Make trademark use of “Dojo Foundation” or “maqetta.org” or other Dojo Foundation-related name or trademark, or refer in a commercial manner to your use of http://maqetta.org, without the prior written approval of the Dojo Foundation.
  • You will comply with applicable government export and import laws and regulations. Specifically, unless authorized by appropriate government license or regulations, you agree not to export, directly or indirectly, any technology, software or commodities provided on or through http://maqetta.org (including software developed by you on http://maqetta.org) to any of the following countries or to the nationals of any of the following countries, wherever they may be located: Cuba, Iran, Sudan, Syria, and North Korea.

You acknowledge that there may be inherent security vulnerabilities in http://maqetta.org. Any programs that you cause to be loaded or any output generated by your use of http://maqetta.org may not be protected from exposure or release to other users of http://maqetta.org or to entities outside http://maqetta.org.

You acknowledge that http://maqetta.org may contain third party code to use within the Site. You agree to use the third party code in a way that does not violate any copyright, patent, trade secret or other intellectual property right.

You are also responsible for complying with all governmental laws, rules and regulations that may be applicable to your use of http://maqetta.org.

The Dojo Foundation does not warrant uninterrupted or error-free operation of or access to http://maqetta.org or that any Site defects will be corrected. You are solely responsible for the results obtained from the use of the Site. This license grant is conditioned on your keeping intact all copyright, trademark, and other proprietary notices and your acceptance of any terms, conditions, and notices accompanying the content or otherwise as set forth in this site.

Your failure to comply with the terms, conditions, and notices on this site and/or accompanying any materials provided on this site will result in automatic termination of any rights granted to you, without prior notice, and you must immediately destroy all copies of downloaded materials in your possession or control.
